After you file, the Trade Marks Registry examines your application and may issue an examination report raising objections. You must reply within 30 days, or the application can be treated as abandoned.
| Ground | What it means |
|---|---|
| Section 9 (absolute) | The mark is descriptive, generic, not distinctive, or contains prohibited matter |
| Section 11 (relative) | The mark is identical or similar to an earlier mark for similar goods or services |
A good reply explains why the mark is distinctive, how it differs from cited marks, and includes evidence of use — invoices, advertisements, website and social media proof, sales figures. If the examiner is not satisfied, a show-cause hearing is scheduled, usually online.
Most objections can be overcome with the right arguments and evidence. We read the report, check the cited marks and draft a reply tailored to your case.

Questions, answered
How much time do I have to reply?
30 days from the date of the examination report. A missed deadline can lead to the application being abandoned.
Does an objection mean my trademark is rejected?
No. It is a query from the examiner. A well-argued reply with evidence often leads to acceptance.
What is the difference between an objection and an opposition?
An objection is raised by the Registry during examination. An opposition is filed by a third party after the mark is published in the journal.
Is there a government fee for the reply?
No fee is charged for filing the reply itself. Fees apply only for certain requests, such as adjournment of a hearing.
