Overview

Copyright protects original literary, artistic, musical, dramatic and cinematographic works, sound recordings and computer software under the Copyright Act, 1957.

Copyright exists as soon as the work is created, but registration with the Copyright Office gives you a certificate that courts accept as proof of ownership — very useful in disputes, licensing and takedowns.

WorkExamples
LiteraryBooks, articles, blogs, course material
SoftwareSource code, apps
ArtisticLogos, illustrations, paintings, photographs
Musical and soundSongs, lyrics, recordings
CinematographicFilms, short videos, ads

Government fee: from ₹500 per work for literary, artistic and software works, higher for films and some categories. After filing there is a 30-day waiting period for objections, then examination.

Copyright generally lasts for the author's lifetime plus 60 years. A logo can be protected by both copyright and trademark — we advise which suits you.

Questions, answered

Is copyright registration mandatory?

No. Copyright exists automatically, but registration gives you legal proof of ownership, which helps a lot in disputes.

How long does copyright last?

For most works, the author's lifetime plus 60 years. For films, sound recordings and some others, 60 years from publication.

Should I register my logo under copyright or trademark?

A trademark protects the logo as a brand for your goods or services. Copyright protects it as artwork. Many businesses do both.

Can I register software?

Yes. Computer programs are registered as literary works, with the source code submitted.
