Trademark Registration — Protect Your Brand Identity

A trademark is a mark used or proposed to be used in relation to goods or services to distinguish those goods or services from those of others. Depending on the circumstances, a trademark may include a word, name, logo, device, combination of elements, shape, packaging, sound or another eligible mark.

In India, trademarks are governed primarily by the Trade Marks Act, 1999 and Trade Marks Rules, 2017. The Trade Marks Registry functions under the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM), Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry.

A registered trademark is generally valid for 10 years and may be renewed for further 10-year periods on payment of the prescribed renewal fee. Registration provides rights in relation to the goods/services covered by the registration, subject to the Act, limitations and applicable exceptions.

Important: India generally follows a first-to-file framework, but prior use can be legally important. Earlier continuous use may provide rights in certain circumstances. Filing early can help establish an earlier application date, but filing does not guarantee registration.

For e-filing a standard trademark application in one class, the official fee is ₹4,500 per class per mark for an Individual, Startup or Small Enterprise, and ₹9,000 per class per mark in other cases. Eligibility for the reduced fee category is subject to applicable requirements. Fees can change under government notifications, so the current IP India fee schedule should be checked before filing.
Which form is used for a new trademark application? +
A new application for registration of a trademark is filed online using Form TM-A. Applications can be single-class or multi-class as permitted under the applicable rules.
Can I use the ™ symbol after filing? +

Is Indian trademark registration valid outside India? +
Indian registration protects the trademark in India. For international protection, eligible applicants may use the Madrid System or pursue national filings in other countries. Each designated country examines the mark under its own law, so international protection is not automatic.
